Tamda Express is a delivery service of Tamda Foods s.r.o. It focuses on all customers operating in the food industry in the Czech Republic, aiming to deliver goods distributed by Tamda Foods directly to customers' stores at competitive prices.
The goal of Tamda Express is to become a reliable and high-quality transportation and delivery service that customers will trust and favor. It is a bridge of business cooperation between Tamda Foods and its valued customers.

Principles of Tamda Express Operations:

The website www.tamdaexpress.eu is owned by Tamda Foods s.r.o. Members on the website www.tamdaexpress.eu are traders who conduct legitimate business activities in accordance with the laws of the Czech Republic and are registered, granted the right to use the services provided by Tamda Express and other related parties offering services on the website www.tamdaexpress.eu. The term "services" includes all services offered by Tamda Express or related to it.

Organizations or individuals participating in transactions on www.tamdaexpress.eu freely agree, based on the principle of respecting the rights and laws, and in accordance with the legal interests of the involved parties, on the activities of buying and selling goods, products, and services, through a contract that does not conflict with the legal regulations.

Goods, products and services that participate in transactions on www.TamdaExpress.eu must fully comply with the provisions of relevant legal regulations. They must not be cases prohibited for business, with a ban on advertising according to the provisions of the law.

Process
How to purchase goods via TamdaExpress.eu
TamdaExpress.eu was built with the aim of supporting as many customers as possible who have a demand to order goods online, as well as with the aim of supporting the creation of a list of goods for buyers that would serve the Tamda Express system - the delivery system - handing over of goods.

In the case of a request to order goods on TamdaExpress.eu, the customer proceeds with the ordering process according to the following steps: (Follow the detailed instructions in the section Instructions for ordering goods on the website www.TamdaExpress.eu).

Step 1: To be able to place an order as well as see information about the price of the system, you need to log in to the system using a registered account with Tamda Express, if you have not yet registered, please register 
Step 2: Select the product you want to order. 
Step 3: When you have seen the information about the goods, you enter the quantity you need, press the button with the icon GIữ Hàng to add the goods to the Giỏ hàng
Step 4: Once you have selected the item you want, you need to press the Place button.
Step 5: On the Shopping Cart Information page, check the list of ordered goods (price, quantity), check the delivery and handover information. Enter additional order information (if any). Then click Submit Order, your order will be created immediately. By submitting your order, you agree to the Tamda Express Terms and Conditions.
Step 6: Order Confirmation: After successfully completing the steps listed above in the instructions, Tamda Express employees will confirm the order by phone call and email according to the registered information.

The confirmation contains the following information:
- Delivery date - After receiving the order, the system will send an SMS notification of the delivery date to the customer's registered phone number. If there is a change from the planned date, please contact the customer service hotline for assistance.
- Additional information: Tamda employees will be asked if the order requires further attention? If so, both parties will discuss further information.

Step 7: Delivery notification: On the day of delivery, the staff will send an SMS to the customer's registered phone number with the following information: order number, order value, date and time, driver's phone number so that you can contact them if necessary.
Step 8: Delivery:
The shipping department will transport the goods to your address for delivery. Before receiving the goods, you must do the following:
- Check and sign the total number of pallets and green crates received. Customers will return the old crates and keep the new crates according to the cart delivery contract.
- Check and sign to confirm that the pallets are intact, with no damaged or broken seals.
- Payment: After signing to confirm the above information, pay the driver the full amount stated on the invoice.

Receiving goods:
- Help the driver to place the goods in the designated place.
- The driver is not obliged to recalculate the delivered order immediately on the spot.
- All complaints are reported by the driver/customer to the customer support department, see Customer Support Contact Details.

Ensuring Transaction Security
The transaction system on the website www.TamdaExpress.eu is designed to guarantee the security of transactions in the following way:
Products offered on the website www.TamdaExpress.eu are products distributed by Tamda Foods. Therefore, Tamda Express guarantees that it will provide customers with the most accurate information when selecting products traded on TamdaExpress.eu.
In addition, Tamda Express implements customer care programs even after the service is used. After receiving the goods, if the customer finds that the product does not match the information we provided, we ask the customer to contact our support for clarification of any questions.

Customer Rights Protection
Protecting customer rights is a goal that Tamda Express aims to achieve. Therefore, we always strive to implement policies that provide customers with transparent and secure services in the areas of purchase, sale, shipping, and delivery. The seller (Tamda Express) is responsible for the quality of goods sold on www.TamdaExpress.eu, as well as the quality of services provided by delivery personnel. In any case, the seller is obligated to address complaints from buyers regarding the quality of goods or services provided.
The buyer has the right to submit a complaint and demand compensation from the seller if the goods or services provided by the seller do not meet the quality stated in the information that was published.
The personal data of customers on www.TamdaExpress.eu are fully protected by Tamda Express according to Tamda Express's privacy policy.
The collection and use of each customer’s information are possible only with their consent, except in cases specified by law.

When a customer places an order or uses a service and a dispute arises with Tamda Express employees, or if their rights or legal interests are violated, Tamda Express commits to actively support customers in protecting their rights and legal interests.

The customer is responsible for securing and storing all activities while using the services under their username, password, and email account. The customer must immediately inform Tamda Express about any unauthorized use, misuse, security breach, or use of login credentials by third parties so that appropriate measures can be taken.
The seller is responsible for the accuracy and truthfulness of the information published on www.TamdaExpress.eu, particularly regarding prices and product quality. Any changes, updates, or corrections to the information must be made on the website.
Members may not use Tamda Express services for illegal, unfair, fraudulent, threatening, spying, or harmful purposes, nor create or spread viruses that could damage the system, configuration, or transmission of information on Tamda Express. If these conditions are violated, the member will be responsible for their actions under the law.
Members may not alter, modify, copy, distribute, provide, or create similar tools of the Tamda Express services for third parties without prior written consent from Tamda Express.

1.1. After registering as a member of Tamda Express and gaining access to the system, members will be supported in using the service, placing orders, and using the system on the website www.TamdaExpress.eu.
1.2. Members will have access to the pricing system on www.TamdaExpress.eu.
1.3. Members will be entitled to various benefits and special offers provided by TamdaExpress.eu or Tamda Foods.

Member Obligations
2.1. Members commit to providing accurate, complete, and current information to Tamda Express and all information uploaded to www.TamdaExpress.eu. Members agree to maintain and update their information on the website to keep it accurate, complete, and current.
2.2. Members are responsible for the content, images, and information about their company and other details on the website www.TamdaExpress.eu.
2.3. Members commit not to use Tamda Express services for illegal, unethical, fraudulent, threatening, illegal information collection, destruction, or spreading viruses that could damage the system, configuration, or transmission of information on www.TamdaExpress.eu. In case of violation, members will bear legal responsibility.
2.4. Members may not alter, modify, copy, distribute, or create similar tools for Tamda Express services for third parties without Tamda Express's prior written consent.
2.5. Members undertake not to change, modify, copy, disseminate, distribute, provide and create similar tools of the services provided by TamdaExpress.eu to a third party without the consent of Tamda Express in these Terms and Services.

Tamda Express Rights and Obligations
3.1. Tamda Express will provide services to members who meet all the necessary formalities and conditions established on the website www.TamdaExpress.eu.
3.2. Tamda Express will create and publish service policies related to individual users on the system. These policies will be posted on the website www.TamdaExpress.eu.
3.3. If it is proven that a member has provided false, inaccurate, or incomplete information, or violated laws or ethical standards, Tamda Express has the right to refuse, suspend, or terminate the member's right to use the services.
3.4. Tamda Express may terminate the rights of members and their right to use all or some services if the member violates Tamda Express's rules or if their actions negatively affect operations on TamdaExpress.eu. The member will be informed of the termination of service within one (1) month.
3.5. Tamda Express reserves the copyright to the services and content on the website www.TamdaExpress.eu in accordance with intellectual property laws in the Czech Republic. All icons and content in all languages are owned by Tamda Express. It is prohibited to illegally copy, use, and distribute these copyrights.
3.6. Tamda Express reserves the right to change the pricing and payment methods for services based on the needs and conditions of Tamda Express. These changes will be published on the website www.TamdaExpress.eu.

Tamda Express Obligations
4.1. Tamda Express is responsible for creating the system, including research, design, hardware and software purchases, internet connection, and creating policies for operating the website TamdaExpress.eu within the permitted conditions.
4.2. Tamda Express will cooperate with partners to create systems and tools that facilitate member and user transactions on the website www.TamdaExpress.eu.
4.3. Tamda Express is responsible for the development and addition of information on e-commerce, commercial legal regulations in the Czech Republic, international legal regulations, foreign markets, and other relevant information regarding activities on TamdaExpress.eu.
4.4. Tamda Express will make every effort to maintain the normal functioning of the website www.TamdaExpress.eu and address issues such as technical failures, software errors, internet connection problems, personnel issues, social changes, natural disasters, power outages, decisions of state authorities, or third parties. However, if events beyond the control of Tamda Express occur and cause damage to a member, Tamda Express will not be held responsible for those losses.

Validity and Application of Terms
5.1. Any dispute between Tamda Express and a member will be resolved based on mutual negotiation. If no agreement is reached, either party may submit the dispute for resolution to the appropriate court in Prague.
5.2. The terms and services of Tamda Express take effect from the date of signing the decision to issue these terms and services. Tamda Express has the right to change these terms and notify members of changes on www.TamdaExpress.eu. New terms take effect from the date of publication of the changes. Continuing to use the services after the changes are announced means agreeing to the changes.

Copyrights and Terms of Use of Services Tamda Foods s.r.o.
Tamda Foods s.r.o. grants the user the right to access and use services according to the terms set in these Terms of Service. All content, trademarks, trade names, logos, and other copyrights (""Copyrights"") displayed on the Tamda Foods s.r.o. websites are exclusively owned by Tamda Foods s.r.o. or third parties, where relevant.
No Copyright Rights: Access to the website Tamda Foods s.r.o. does not mean that any rights or licenses to use the copyrights are granted to you. You do not have the right to use, copy, transfer, or claim any rights to these copyrights.
Compliance with Legal Regulations: By using Tamda Foods s.r.o. services, you agree to comply with all legal regulations concerning copyrights, trademarks, trade names, and other legal regulations that protect the services, websites, and content on Tamda Foods s.r.o. websites.

Return of Goods
Goods that were mistakenly ordered by the customer will be accepted for return within the company's capabilities.
Information about the return of goods must be communicated to Tamda Express employees within 7 days from the receipt of the goods.
We accept exchanges or returns of goods that have quality issues or are incorrectly delivered due to Tamda Foods' mistake (e.g., delivery of a different type of goods, delivery of a greater quantity than ordered).

Information that must be provided to Tamda Express employees regarding returned goods:
- Date of receipt of goods
- Order number (ID ORDER)
- Product code – EAN or internal code
- Reason for return
- Quantity of returned goods

The company will only accept the return of goods after receiving all necessary information and approval of the return. The company will accept returned goods within 14 days of receipt.
The customer will bear the shipping costs of the returned goods or can return the goods during delivery, but no later than 14 days from receipt of the goods/confirmation of the return by the company.
Complaints regarding product quality will be accepted and resolved within 3 months from the delivery date.

Complaints
The company accepts complaints about goods only within 7 days from the delivery date.

Terms Regarding Deposit and Return of Pallets

DEPOSIT
When paying a deposit for pallets, the driver will issue two receipts, one to be given to the customer, the other to be kept by the driver. Upon returning the pallets, the customer must have the deposit receipt. If the customer does not have the receipt, Tamda Foods will refuse to accept the pallet back.
The deposit receipt for the pallet is valid only for 6 months from the date of payment.

INSPECTION UPON RETURN
SERIOUS DEFECTS, WE DO NOT ACCEPT
A pallet that does not meet circulation standards due to the following serious defects:

Unstable connection: The pallet board is not securely attached to the wooden pads. This defect severely affects the load-bearing structure of the pallet.
Cracks and broken construction: Complete cracks, splits, or breakage that directly affect the load-bearing structure – support pads and connecting boards.
Crack across the support pad: A complete crack in the support pad that causes the loss of a firm connection between the top and bottom of the pallet.
Missing part of the structure: Breakage causing the loss of more than 50% of the contact surface between nails on the connecting board and the support pad or other parts of the pallet structure.
Missing part of the pallet: Loss of a complete part of the pallet structure.
Contaminated pallet: The surface of the pallet is contaminated, which may jeopardize health and food safety (stains, wood shavings, mold, etc.).

ACCEPTABLE PALETTE DEFECTS
Pallets with the following defects may be temporarily accepted for circulation:

Minor chipping, cracks: Chipped or cracked pieces with a width:
- No more than 35 mm along the length of the connecting board between the support pad and the outer edge of the pallet.
- No more than 10 mm if the piece cracks along the entire length of the construction board.

Maximum of 2 cracks on one pallet with the specified dimensions.
Crack, breakage: Oblique or transverse cracks that affect the entire thickness of the board, provided that the connecting board is securely attached with nails at both ends and the board is not bent in relation to the other parts.
This crack or break will be accepted only on the upper board.

Nails: Although nails must be kept flush with the surface of the pallet, it is not possible to fully avoid this during use.
If the nails protrude less than 3 mm above the wood surface, it is not a serious defect.
Protruding nails can be accepted if their placement is not dangerous.
Not accepted if nails are placed at the edge of the pallet or in other inappropriate places.

Tolerance of overall dimensions: The allowed tolerance of overall dimensions is 10 mm. The standard size of the pallet is 1200x800 mm, with a tolerance of 10 mm allowed for both dimensions.
Terms for Deposit and Return of Plastic Bins
The customer and Tamda agree on the transfer and return of plastic bins with the Tamda Foods logo (hereinafter ""Bins"") used for delivery to the customer under the following conditions:

The customer agrees to receive the bins and return them to Tamda Foods with the next delivery.
The bins will be used only for the delivery and storage of Tamda Foods goods.
The quantity of bins will be recorded on the invoice for each delivery with a price of 0 CZK.
Tamda Foods will collect the bins with the next delivery. If the customer does not return the bins, Tamda Foods will charge a deposit of 250 CZK per bin.
The customer agrees to accept the goods in the ordered bins.

Tamda Foods requires compensation if the bins are damaged, deformed, or broken and cannot be used, at a value of 250 CZK per bin.
